P.C.:­ By an Order dated 26th July, 2018 the Applicants have been granted interim relief.

Heard the learned counsel appearing for the Applicant and the learned APP. Perused the record of investigation. The record of investigation indicates that, though it is alleged by the prosecution that, the Applicant was partner in the firm namely Divine Leisure International, situated at Dabholkar Corner, New Shahupuri, Kolhapur, the legal record is silent on that aspect. It is the contention of the Applicant that, he was employed with the said company, which was being run by Shri. Sankalp Saurabh Singh, 1/2

ssm 2 25-aba1419.18.doc proprietor of the said firm. The record indicates that, the amounts deposited by the customers were utilized by the said Shri. Sankalp Saurabh Singh.

In view thereof, the custodial interrogation of the Applicant for further investigation of the present crime is not necessary and the Applicant deserves to be protected by pre­arrest bail.

The interim relief granted by order dated 26th July, 2018, is hereby confirmed.
