The applicant-accused is convicted for offences punishable under Sections 302, 324 and 506 of the Indian Penal Code, 1860 and sentenced to suffer life imprisonment. The appeal filed by the applicant is admitted and the present application is filed for bail during the pendency of the appeal.

The allegations against the applicant is that he committed murder of his friend Parshuram with an axe. The assault by the applicant on deceased was witnessed by PW-1 Bhagwan and PW-2 Rahul. Both of them stated that the present applicant followed deceased Parshuram and gave him blows with said axe from back-side. The deceased thereafter shouted Aaiga and fell down on the tar road. The applicant thereafter gave second blow with the said axe on the neck of the deceased. The deceased succumbed to the injuries which were inflicted by the applicant with the said axe.

Taking into consideration the above evidence on record, we are not inclined to entertain this application. We do not find any merit in the application. The criminal application is, accordingly, dismissed. [SURENDRA P. TAVADE, J.] [RANJIT MORE, J.] Shubhada S Kadam 2/2
