Though served none appears for the non-applicant/ husband.

The prayer is for transfer of Petition No.A-3179 of 2018 pending on the file of Family Court No.3, Bandra, Mumbai to Learned Civil Judge Senior Division, Sangli.

The parties got married on 30th October, 2009 at Mumbai and I am informed that out of said wedlock, parties are blessed with a daughter who is in the custody of the applicant. It is claimed that there are other proceedings viz. initiated under Section 12 of Domestic Violence Act proceedings ("DV Act" for short) are pending on the file of Court at Islampur.

As contentions raised in the application with regard to the hardship are not resisted, case for transfer is made out as it is established that the applicant will suffer more hardship. 5.

That being so, application is allowed in terms of prayer clause (a).
