The order impugned in the writ petition is interlocutory in nature capable of being challenged in a substantive appeal in case the decree goes against the petitioners.

Hence, keeping all contentions raised by the petitioners open to be agitated under Section 105 of the Civil Procedure Code, 1908, the writ petition stands disposed of.

However, contentions raised by the petitioners regarding the nature of the suit properties shall be decided at the time of hearing of the suit.
