Learned AGP raises a preliminary objection that the remedy against order of the Commissioner is available before the Hon'ble Minister. In view of the objection raised by the learned AGP, learned counsel for the Petitioner seeks permission to withdraw the Petition with liberty to file the Revision Application before the Hon'ble Minister.

The Petition is permitted to be withdrawn with liberty as prayed.

It is made clear that this Court is not gone into the merits of the matter and all rights and contentions of both the parties are expressly kept open.
