Heard Mr. Abhijit Adagule, learned Counsel for the Petitioner and Mr. S. B. Kalel, learned AGP for the State.

Petitioner by this petition prays for a direction to the Respondents to take action against the illegal encroachments done upon the Government land bearing Gat No.456A used as Gayran by villagers of Wadicharan.

This Court by the order dated 13th March, 2020 has granted time to the AGP to file additional Affidavit-in-Reply indicating the extract of Gat No.456A.

Learned AGP seeks some more time to file the Affidavit-in-Reply. 5.

In our opinion, the present petition need not be kept pending any

4-wp-12169-2019.doc further. As there are encroachments on the Gayran land, it is expected of the Respondents, to take action against the encroachments in accordance with law.

The Respondent No.2-the Collector, Kolhapur to enquire into the matter, either by himself or through Authorized Officer regarding the status of the encroachments. After calling for the report and upon hearing the Petitioner and the persons to be affected, appropriate order be passed by the Collector Kolhapur in accordance with law. Depending on the report received, the Collector Kolhapur to take appropriate action against the illegal encroachments within a period of four months from today.

The Writ Petition is disposed off.
