Though respondent is served, he has failed to appear before this Court.

By this application, applicant is seeking transfer of petition pending before the Family Court at Bandra filed by respondent to Family Court at Solapur.

It is the contention of learned counsel for the applicant that applicant is a permanent resident of Solapur and it is not possible for her to come to Mumbai to attend every Court date. The respondent has filed petition for divorce against the applicant under Section 13A of Hindu Marriage Act, 1955, at Family Court at Bandra. The applicant has filed proceeding under Domestic Violence Act which is pending before the SHUBHADA SHANKAR KADAM CJM, Solapur, hence, requested to transfer the divorce petition filed by respondent to Family Court at Solapur.

Considering the submissions of learned counsel for the applicant and reasons mentioned in the application, I pass following order :

O R D E R

1. Application is allowed.

2. Petition No.A/2019/2022 pending before the Family Court at Bandra be transferred to Family Court at Solapur.
