Learned counsel for the applicants submits that he has no instructions regarding heirs and legal representatives of deceased sole respondent. He further submits that the appeal stand abated in view of death of sole respondent.

In view of the aforesaid, the application for condonation of delay is dismissed as abated. In view of dismissal of the civil application, the second appeal also stands dismissed as abated. 3.

It is clarified that it will always be open for the applicants to apply for setting aside abatement.
