The application is taken out with a prayer for directions to the respondent to ensure payment to the applicant i.e. respondent to the main petition pursuant to the provisions of 17B of the Industrial Disputes Act.

2 12.1722.18 caw.doc The record and reply filed to the petition by employer depicts that the amount pursuant to 8th and 9th bipartite settlement is already secured, which amount, pursuant to the direction of this Court is already deposited in this Court.

In the wake of above, application, in my opinion does not warrant any further consideration. As such, application stands disposed of.

Considering the fact that the respondent­employee is already superannuated and his entitlement to the back wages is an issue which is required to be gone into, it will be appropriate in my opinion to direct that the matter be added to final hearing board in the week commencing from 18th November, 2019.
