Learned advocate appearing for the Petitioner has tendered Minutes of Order which is duly signed by the both parties, the same is taken on record and marked "X" for identification. Respondent Nos.1 and 2 have filed their affidavits in reply dated 5/10/2017 and 6/11/2017 respectively Pg 1 of 2

4.wp.8764.2017.doc and stated that the Petitioners were not debarred by the National High Way Authority of India ("NHAI") and the Respondents have no objection in awarding the tender work to the Petitioner. Respondent Nos.3 and 4 in the affidavit presented today in this Court have specifically recorded in paragraph 6 that they have no objection in awarding the tender work to the Petitioner Company.

Considering the contentions raised in the affidavits by the respective parties, there shall be no difficulty in allowing the Petition. The Petition is allowed in terms of prayer clauses (a), (b) and (c). In view of the above, Rule is made absolute. There shall be no order as to costs.
