The Trial Court, by the impugned order, has rejected the petitioners' application under section 10 of the Civil Procedure Code, 1908. On perusal of the plaint, it appears that the first suit is for recovery of amount, however, the second suit is for injunction. Hence, the rejection of the application under section 10 of the Civil Procedure Code, 1908 does not suffer from legal infirmity. The writ petition is, therefore, dismissed.
