DATED : 26th FEBRUARY, 2025 P.C:- The petitioner has prayed for quashing of the chargesheet which has accused him for committing the offence punishable u/s.336 and 338 of IPC, in the wake of the collapse of the Volley Ball gallery, which was erected for a Volley Ball event being organised to be occupied by the spectators and the allegation is that without taking appropriate care for its potential to bear the weight, when the public watch the volley ball matches from the said gallery, it collapsed and one Abhishek Ajit Pawar, son of witness no.4 and 5 received serious spine injury, resulting into fracture. When we have perused the material in the charge-sheet and in the wake of the same, we are not inclined to show any Tilak

2/2 5 WP 3186-14.doc indulgence as it is supported by relying material including various statements as to how the incident took place resulting into the injury who was a spectator in the gallery. Finding no merit and substance, since we are of the opinion that the petitioner must undergo trial, Writ Petition is dismissed.
