The Appeals filed by the Respondents above named under Section 44(4) of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965, are pending before the State Government. The Petitioner

aggrieved by the fact that an exparte stay to the order of disqualification is granted to the Respondents herein has filed the above Petitions. The Learned Counsel for appearing on behalf of the Petitioner Mr. Sangvikar holding for Mr. Mankapure on instructions states that the Petitioner would be satisfied if the Appeals pending before the State Government are directed to be disposed of within a particular time frame. Since the Appeals are pending from August 2014 and since the issue involves about the disqualification of ten Municipal Councilers of the Municipal Council. In my view, it would be just and proper to direct the concerned authority of the State Government to hear and decide the Appeals latest by 31­8­2015.

Needless to state that the said Appeals would be decided on their own merits and in accordance with law, by giving proper opportunity to the parties. The Learned AGP Mr. Rayrikar to inform the aforesaid developments to the concerned authority of the State Government. With the aforesaid directions, the Writ Petitions are disposed of. [R.M.SAVANT, J]
