By this application, the applicant is seeking transfer of Hindu Marriage Petition No. 43 of 2024 filed by the respondent which is pending before the Civil Judge, Senior Division, Gadhinglaj to Family Court, Sangli.

It is the contention of learned counsel for the applicant that applicant stays at Sangli. She has no source of income. The distance between Gadhinglaj to Sangli is more than 120 km. The applicant is finding it difficult to attend the Court dates at Gadhinglaj. Hence,

requested to allow the application.

It is contention of learned counsel for the respondent that the respondent is ready to pay travelling expenses to the applicant. This application is filed by the applicant only to harass the respondent, hence, requested to reject the application.

The applicant stays at Sangli. Applicant is a lady and she has no source of income. The distance between Gadhinglaj to Sangli where the Marriage Petition filed by the respondent is pending, is more than 120 km. She finding it difficult to attend the Court dates at Gadhinglaj. It is settled principle of law that convenience of the wife has to be considered over the husband. Considering these facts, I pass the following order.

O R D E R

I.

Application is allowed.

II.

Hindu Marriage Petition No.43 of 2024 pending before the Civil Judge, Senior Division, Gadhinglaj be transferred to Family Court, Sangli.

III. Both parties to appear before the Family Court, Sangli. IV.

The respondent can file application to appear through video conference before the learned Family Court, Sangli. The learned Family Court, Sangli shall decide the said application on its own merit.

V.

The learned Family Court, Sangli is requested to keep the dates of D.V. proceeding filed by the applicant and the present Petition on same day.

Application stands disposed off.
