The present Interim Application has been filed for condonation of delay of a period of 5 years 1 months for seeking restoration of Writ Petition No. 1962 of 1997.

Considering that the Writ Petition was admitted, the lis between the parties is required to be adjudicated. Adequate reasons are given in the Application and the negligence of the Advocate cannot be attributed to the Petitioner. I am inclined to grant the Application, subject to the Applicant paying costs of Rs.25,000/- to be paid by him to the Kirtikar Law Library, High Court, Mumbai within a period of two weeks from today. The receipt of payment shall be placed on record of the present case.
