DATE : 20 FEBRUARY 2020 P.C.:- On 23 January 2020 we had passed the following order : "The learned Counsel for the Petitioners states that the issue raised in this Petition of setting aside the Government Circular dated 13 June 2016 and a declaration that Clause 2(b)(3) of the Government Resolution date 1 April 2010 not being applicable to the Sectional Engineer, now stands answered in favour of the Petitioners by the decision rendered by this Court in Writ Petition No. 2605 of 2017 on 6 February 2019. The learned AGP seeks time to examine this position and make a statement.

Stand over to 20 February 2020 under the caption "For Directions". We direct the concerned officers to examine the issue and instruct the learned AGP accordingly."

The learned AGP states that he has received instructions that the issue has been examined by the State and he has received instructions that the contention of the Petitioner that the Petitioner is covered by the law laid down in Writ Petition No. 2605 of 2017 is correct. In view of this statement, we direct the Respondents to issue necessary communications to the Petitioner based on the decision of this Court in Writ Petition No. 2605 of 2017 within a period of 8 weeks from today.
