The submission is made by the learned counsel appearing for the Petitioner and also by Respondents that in similarly situated matter, this Court had passed order of remand directing the Education Officer to take fresh decision on the cancellation of approval as it was passed without hearing the Petitioner.

Therefore, based upon that order passed in Writ Petition No.8937 of 2014 (Vilas s/o Pritam Pawar and ors Vs. The State of Maharashtra and ors) dated 4th March, 2015, we are inclined to allow the present petition. The impugned order dated 7th August, 2014, cancelling the approval of the Petitioner is set aside. The Education

925 wp.8048.14.odt Officer is directed to consider the issue again after hearing the Petitioner. The Petitioner to appear before the Education Officer on 3rd August, 2015. No question of issue notice to the Petitioner again. All points are kept open.
