The State Of Maharashtra

----- Adv. Ritesh M. Thobde a/w Adv. Changdev Shingade and Adv. Mervin Bardeskar, Advocate for the Applicant. Mr. Anand Subhash Shalgaonkar, A.P.P., for the Respondent - State. ----- CORAM : SHIVKUMAR DIGE, J.
DATE : 16th DECEMBER, 2025.
P.C. :
1.
By this application the applicant is seeking relaxation of condition imposed by this Court (Coram : Madhav J. Jamdar, J.) dated 23rd January, 2024.
2.
It is contention of learned counsel for the applicant that condition No.(b) is imposed on the applicant by this Court directing applicant not to enter in Taluka-Mohol, District-Solapur after being released on bail except for reporting to the Investigating Officer, if called. Learned counsel further submitted that applicant's family stays ZIP 1/2
75-IA-2397-2025 (CR).doc at Mohol Taluka. It is further submitted that the applicant is out of Mohol Taluka for around two years. Hence, requested to allow the application.
3.
The learned APP for the respondent-State strongly objected to allow the application on the ground that the applicant himself made the statement before the Court that he will not enter in the Mohol Taluka, now he cannot seek relaxation of this condition and requested to reject the application. Learned APP further submitted that respondent No.2 is informed about the pendency of this application. 4.
I have heard both learned counsel. Applicant's family stays in Mohol Taluka. He is away from his family for around two years. Considering these facts, I pass following order :
ORDER
A.
Application is allowed;
B.
The condition No.(b) imposed by this Court is hereby relaxed.
5.
Application is disposed off accordingly.
