It appears that on 8th March 2021 Writ Petition No.7212 of 2005 came to be dismissed observing as under :
"1. This Petition has been notified as per the list of matters as received from the office of the learned Government Pleader to have become infructuous. As per the office notice dated 2nd March 2021, the Advocate for the petitioner/applicant-petitioner/applicant was called upon to give a praecipe in advance in case the petition has not become infructuous. Such praecipe has not been received in regard to this petition. Accordingly, the petition is disposed of as infructuous; however, with liberty to the petitioner to revive the petition in case something survives.
2. Disposed of in the above terms. No costs.
3. The pending Civil Applications, if any, do not survive and stand disposed of."

As we glance at the order dated 8th March 2021 we gather that on that date the learned counsel petitioner was not present. It further appears that a statement, may be not too correct, was made by the learned Government Pleader that the writ petition has become infructuous and that was the reason Writ Petition No.7212 of 2005 came to be dismissed. Now by virtue of liberty granted to the petitioner vide order dated 8th March 2021, this interim application seeking restoration of the writ petition has been filed which stands allowed and consequently, Writ Petition No.7212 of 2005 is restored to its original records to be listed in due course.
