The applicant is seeking anticipatory bail in C.R. No. 96 of 2019 registered with Borgaon Police Station, Dist. Satara for offences punishable under Sections 420, 465, 467, 468, 471, 472, 475, 120-B r/w Section 34 of Indian Penal Code.

The prosecution case is that the complainant was acquainted with accused Sachin Tarafdar. Subsequently, he was introduced to applicant. They assured about employment in Railway Department by taking money from him. The complainant had parted of an amount of Rs.3,80,000/-. Thereafter his father paid Rs. 1,77,000/- to Sachin Tarafdar. In the month of September, 2017 he received bogus appointment letter. The accused cheated several persons, hence, FIR was registered. Statement of various persons who were deceived and

Sajakali Jamadar 2 of 3 926.1-ABA-1660-2019.doc the statements were recorded. The husband of the applicant Amol Madankar was arrested on 29th June, 2019. On completing investigation, charge-sheet has been filed against him. 3.

On perusal of the FIR, it is apparent that the role attributed to the applicant is that she had represented to son of the victim that they should pay money to her husband for arranging their employment. The applicant was granted interim protection by this Court vide order dated 26th July, 2019. The applicant has complied the direction in interim order. Learned APP submitted that overt act has been attributed to the applicant which is spelt out in the FIR. Husband of the applicant is in custody. He has preferred application for bail. The application for bail preferred by Amol Madankar is also heard along with this application. He has been granted bail on the ground that amount parted to him was returned to victims. Considering the aforesaid circumstance and the role attributed to the applicant her custodial interrogation is not necessary. Hence, the interim protection deserves to be confirmed.

O R D E R

i) In the event of arrest of applicant in C.R. No. 96 of 2019 registered with Borgaon Police Station, Dist. Satara, the applicant be released on bail on

ii) The applicant shall attend the investigating Officer as and when called for till filing of chargesheet. iii) Ancitipatory Bail Application stands disposed of accordingly.
