This is an application under Section 438 of Code of Criminal Procedure for anticipatory bail.

The applicant is apprehending his arrest in Crime No.216 of 2022 registered at Karveer Police Station, Kolhapur for the ofences punishable under Sections 406 and 420 of the Indian Penal Code.

I have heard the learned counsel for the applicant and the learned APP for the State.

The allegations against the applicant and other co-accused are of duping the complainant to the tune of Rs.86,77,932/-. 5.
On 10 April 2023, this Court passed the following order: "1.
The learned counsel for the applicant, on instructions, submits that the applicant is ready and Dinesh S. Sherla 1/2
23-aba-2347-22.doc willing to pay amount of Rs.6 lacs to the complainant which he has allegedly received from the co-accused. The applicant shall deposit the said amount in the bank account of complainant by the next date.

List the application on 25 April 2023. Till the next date, the applicant shall not be arrested."

The learned counsel for the applicant submits that pursuant to aforesaid order the applicant has deposited amount of Rs. 6 lakhs in the bank account of the complainant. 7.
The main allegations are against the co-accused Vishnu Pawar. Considering the overall facts and circumstances, I am inclined to release the applicant on anticipatory bail. In the result the following order is passed.
ORDER
A) The Application is allowed.
B) In the event of arrest of the applicant in C.R. No. 216 of 2022 registered at Karveer Police Station, Kolhapur for the ofences punishable under Sections 406 and 420 of the Indian Penal Code, he be released on bail on executing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount. C) The applicant shall attend the concerned police station as and when called by the Investigating Ofcer and shall cooperate in the investigation.
