Heard Shri Rahul Mehta, learned counsel for the Applicant in the Civil Application and Mr. Bohade, learned counsel for the Respondent Nos.1 to 4.
2.
With the assistance of the learned counsel, perused a copy of the application dated 4 July 2018 filed by the Applicant for condonation of delay of 22 days in filing the present First Appeal. 3.
The First Appeal is filed against the judgment dated 3 March 2018 passed by the Motor Accident Claims Tribunal ("M.A.C.T." for short) at Pallavi Wargaonkar, PS 1/2
5-CAF-337-2019 (C) .doc Satara. The Applicant has set out the reasons for such delay in his application. Perusal of the said reasons indicate that the delay is not attributable to any fault of the Applicant and is for reasons beyond the control.
4.
In my view, just and sufficient cause to condone such delay has been made out. The learned Advocate for the Respondent fairly states that he does not have any serious objection with regard to such application for condonation of delay. In light of the above facts and circumstances and in the interest of justice, the above Civil Application for condonation of delay is allowed in terms of prayer clause (a).
5.
First Appeal is restored to the file of this Court. 6.
All contentions of the parties are expressly kept open. 7.
List the First Appeal for admission on 3 January 2025. [ADVAIT M. SETHNA, J.] Pallavi Wargaonkar, PS 2/2
