Having heard respective Counsel the explanation tendered by the Investigating Officer who is personally present in the Court for his absence is accepted.

Pursuant to the assurance given by the learned APP that the Investigating Officer will be diligent henceforth. 3.
Having heard the matter on merit, what is noticed is, the Applicant is public servant. His involvement in the crime is to the extent of
2/2 Yadav 3.aba.1559.18 getting the document executed pursuant to the misleading of instructions given by the higher authorities. No criminal intention could be inferred. 4.
That being so, the adinterim protection ordered by this Court on 13th August 2018 stands confirmed. In addition that - (A) In the event of arrest in Crime No. 299 of 2018 for an offence punishable under Sections 464, 465, 468, 469, 471 read with Section 34 of Indian Penal Code, the Applicant be released on executing PR Bond of Rs.25,000/ with one or more sureties in the like amount.
(B) The Applicant shall attend the Investigating Officer as and when directed.
(C) The Applicant shall neither tamper the evidence of prosecution nor influence the prosecution witnesses.
