Learned APP has drawn our attention to the report dated 06.10.2022 prepared by Senior Superintendent, Kolhapur Central Prison, Kalamba, Kolhapur which states that Petitioner had been released on Covid parole for 45 days. In that view of the matter, grievance of Petitioner in his Application for release on parole would not survive.

It is to be noted that by a substantive order dated 27.02.2019 in Criminal Writ Petition No. 850 of 2019 filed by Petitioner through jail challenging the earlier rejection orders dated 21.08.2018 and 06.12.2018 this Court set them aside and passed fresh direction to the Competent Authority (Divisional Commissioner, Pune Division) to reconsider his Application for parole afresh and pass order. 3.

Petitioner is at liberty to challenge the order if being aggrieved. 1/2
