By this civil application, the applicant seeks condonation of delay of 38 days in filing the first appeal. Heard learned counsel appearing for the parties who are present in Court. 2.

Delay in filing the first appeal is explained in civil application. Reasons recorded in the civil application are accepted. Civil application is made absolute in terms of prayer clause (a). In so far as prayer clause (b) is concerned, the said prayer is separately prayed in Civil Application No.5433 of 2008 and would be considered in that civil application. No order as to costs.
