DATED : 28th APRIL 2023 P.C:- The appellants are admitted to interim protection by order dated 29/8/2022, wherein the prima facie case has been recorded in their favour. The complaint lodged, would reveal that it is the complainant, who is alleged to have apprised the appellants that he belong to a particular caste and it is alleged that the act of encroaching upon his land has been committed with an intention of harrasment.

The interim protection granted in favour of appellants continue till today.

2/2 8 APEAL 860-22.doc The learned APP on instructions of SubDivisional Police Officer, Khed Sub-Division, Ratnagiri make a specific statement that the custodial interrogation is not necessary as the charge-sheet is already filed on completion of investigation of the subject CR. The said statement is recorded in the communication addressed to the learned APP, which is taken on record and marked as "X" for identification. In the wake of the above, the order dated 29/08/2022 is made absolute.

I would like to put on record my appreciation for Mr. Shashikant Chaudhari, who has rendered his able assistance to this court, upon being appointed to represent respondent no.2.The legal Services Authority shall ensure the payment of his legal remuneration within a period of six weeks from today.
