After the matter was argued for some time, it is agreed between the parties that suffice would be the purpose to dispose of Writ Petition with the following directions. (I) Respondents have already filed written statements as per the directions given in impugned Judgment and Order dated 20 July, 2011.

(ii) Issues be framed within a period of four weeks from today, by the Trial Court.

(iii) Petitioner / Plaintiff to file affidavit of evidence of his witness within further period of four weeks, Sharada

(iv) The Respondent / Defendant after filing of Affidavit of evidence by Plaintiff to cross examine the witness of the Plaintiff within a further period of eight weeks.

(v) If no further witness are examined by the Petitioner. The Respondent to file his list of witness along with document relied upon within the further period of four weeks. The Respondent to thereafter, file its affidavit in examination chief within a further period of four weeks.

(vi) After evidence is closed, Trial Court to make endeavour to hear the parties and dispose of the suit within a further period of four months.
