It is pointed out by learned Counsel for the Respondent No. 4 and 5 that the present Petition makes grievance that Respondent No. 4 have shifted the Respondent No. 5-School in the year 2021-22 from Village Kokare to Village Karve, Tal-Chandgad. Respondent No. 5-Secondary School is presently running at Village Kokare and not at Village Karve. Thus, the allegations/grievances made by the Petitioners is without any Shubham Talle 1 of

54 Wp-11061-2022.doc base and/or foundation. However, we are not considering this contention of learned Counsel for the Respondent No. 4 as there is no representation on behalf of Petitioner.

It is pointed out that hearing was conducted before the Deputy Director of Education - Kolhapur Division, Kolhapur in respect of the said shifting of the Respondent No. 5-School. It is pertinent to note that hearing was conducted on 24th March, 2025. Several compliances were effected on 9th May, 2025 as recorded in the impugned order and fresh order has been passed by the Deputy Director of Education-Kolhapur dated 11th June, 2025.

In this view of the matter, nothing survives for consideration in the present Petition and the same stands disposed of. 5.

It is open for the parties to challenge the order passed by the Deputy Director of Education on its own merits and in accordance with law. We have not examined the merits of the Petition and all contentions are expressly kept open.
