The applicant claims to be a co-opted director being a legal expert / advocate.

Counsel for the applicant would invite my attention to the fact that the other two similarly placed co-accused viz. Chartered Accountants are already released on pre-arrest bail by the court below. According to him, the applicant has resigned from the post of co-opted director on 30.11.2013. He would further urge that his signature on some of the loan proposals / approvals is disputed. 4.

In response to the aforesaid submission, the Additional Public Prosecutor has placed on record affidavit of Mr. Mohan Dadasaheb Shinde, Deputy Superintendent of Police, Economic Offence Wing, Satara sworn on 12.09.2022. The said officer has specifically stated that the applicant / accused No.17 was an expert director of Harihareshwar Co-operative Bank. According to him, during investigation, no material is found against the applicant except this. Hence, applicant's custodial interrogation is not required. As such, according to him once the sanction is received from the Superintendent of Police, Satara under 1/2

In view of the aforesaid statement made by the Investigating Officer on the affidavit which is taken on record, the present application stands disposed of.
