The learned Advocate appearing for Respondents raises objection that since order of rejection of plaint has been passed by trial Court in exercise of powers under Order 7 Rule 11 of Code of Civil Procedure, Appeal needs to be filed challenging said order and Civil Revision Application is not maintainable. 2.

There cannot be dispute that order rejecting plaint is appealable.

In this backdrop, Civil Revision Application shall stand disposed of as withdrawn with liberty to Applicant to file appeal. Gaikwad RD 1/2

In case, such Appeal is filed, time consumed in prosecuting present Civil Revision Application be considered while computing limitation.
