Heard the learned counsel for the petitioner and the learned AGP for the respondent Nos.2 to 4. Our attention is invited to the letter dated 7th February 2014 addressed by the Deputy Commissioner (Resettlement), Pune Division, Pune to the Deputy Collector (Resettlement), Kolhapur. The said letter shows that the application made by the petitioner to the Divisional Commissioner on 30th December 2013 has been forwarded to the Deputy Collector (Resettlement), Kolhapur for necessary action. Hence, we dispose of the petition by passing the following order:

(I) We direct the petitioner to appear before the Deputy Collector (Resettlement), Kolhapur

wp8880 on 7th December 2015 at 11.00 a.m.;

(II) The petitioner shall produce an authenticated copy of this order along with a true copy of this petition before the Deputy Collector on that date;

(III) The Deputy Collector shall issue a notice to the respondent No.1;

(IV) After giving an opportunity of being heard to the petitioner as well as the respondent No.1, the Deputy Collector shall pass an appropriate order on the application dated 30th December 2013 as expeditiously as possible and in any event,s within a period of six months from 7th December 2015;

(V) We make it clear that no adjudication has been made on merits of the application and all contentions on merits of the application are kept;

(VI) Writ petition is disposed of on above terms.
