The only prayer made by learned counsel for the petitioner is to dispose of this petition by directing respondent No.4 to consider and decide the petitioner's claim as reflected in "Exhibit F" to the petition keeping in view the order passed by the Division Bench of this Court in writ petition No.8568 of 2011on 30th July, 2012 in the case of Gangadhar Nivruti Korde versus the Head Master, Maratha High School, Nashik and ors.

Having considered the aforesaid prayer without Shubhada S Kadam 1/2

Sr.No.15 WP 10082.15 commenting about the petitioner's entitlement, we direct respondent No.4 to consider and decide the petitioner's claim as reflected in "Exhibit F" keeping in view the order passed by the Division Bench of this Court on 30th July, 2012 in the case of Gangadhar Nivruti Korde(supra). Let the decision as aforesaid be taken within eight weeks from the date of receipt of this order. The petition, accordingly, stands disposed of. 4.

Needless to say that we have not expressed our view on the merits of the petitioner's contention and the authority concerned will be free to pass the order in accordance with law and keeping in view the aforesaid order passed by the Division Bench of this Court.
