We have perused the office report dated 16th December 2019 of the Deputy Registrar, Civil Writ Branch. The report indicates that in another connected PIL No. 49 of 2009 filed on 6th January 2009 by the petitioner - Vishnu Dattatrya Barve for directions to the Divisional Commissioner, Pune, which came to be disposed of by this Court (Coram: Swatantra Kumar, C.J. & Dr. D.Y. Chandrachud, J.) by passing the following order:- 1 of

"P.C.:

We have heard the learned counsel appearing for the parties. The learned counsel appearing for the State submits that the report received from the Collector, Pune shall be considered by the appropriate authority and necessary steps will be taken in accordance with law without any further delay.

2. In view of the statement made, we do not find it appropriate to keep this petition pending before this Court. The same is disposed of with a direction to the respondents to take appropriate consequential actions on the basis of the report submitted by the Divisional Commissioner, Pune as referred to in the petition and examine if there is any need for the Disciplinary Authority to take action against the erring officers if they are found to be guilty. The said steps to be taken expeditiously."

After disposal of PIL No. 45 of 2009, the petitioner filed the present petition and prayed for directions to the respondent no.1 to take necessary steps and consequential action on the report submitted by the Divisional Commissioner, Pune, as well as the Regional Director, Pune Division, Pune.

In view of the directions of this Court on 29th January 2009 to the Divisional Commissioner, Pune in PIL No. 49 of 2009, no further directions in the present petition are necessary. In case, the petitioner is aggrieved by communication on the part of the respondents in complying with the order dated 29th January 2009 in PIL No. 49 of 2009, it is open for the petitioner to resort to appropriate remedies as per law. 2 of
