We have heard Mr. Bhutekar, learned Counsel for the petitioner at some length.

to obtain instructions. It may not be necessary to obtain instructions in view of the order, we propose to pass.

By this petition preferred under Article 226 of the Constitution of India, the petitioner prays for following substantive relief; "(a) Be pleased to direct the Respondent Nos.1 & 2 to initiate departmental inquiry as against Respondent No.3 in respect of the illegalities which are pointed out in the present Petition and on enquiry if proved guilty take appropriate action on Respondent No.3."

It is not possible to grant such relief as prayed for in the present petition. In such view of the matter, Mr. Bhutekar submitted that this petition itself be treated as representation to the respondent No.2 so that further action can be taken by him. Accordingly, this petition can be disposed of by permitting the petitioner to place this petition alongwith a detailed representation before respondent No.2 within a period of two weeks from today. The grievance of the petitioner in the representation as well as the one raised in this petition may be looked into by respondent No.2 on which further action, as required, may be taken by respondent No.2 in accordance with law. It is made clear that we have not made any observations on merits on any of the contentions raised by the petitioner.

Representation to be looked into by respondent No.2 as expeditiously as possible, preferably within a period of sixteen weeks from the date of submitting the representation.

The petition is disposed of in the aforesaid terms. No order as to costs. 7.

All contentions are kept open.
