Heard the respective counsels.

The learned counsel for the Applicant i.e. Original Respondent submits that the First Appellate Authority i.e. Divisional Commissioner, S.T., Ratnagiri to decide the First Appeal preferred by the Applicant expeditiously irrespective of pendency of the writ petition.

The application pertains to the proceedings of departmental inquiry whereas the order passed by the Industrial Court has been

6-CAW 1864 of 2018 stayed by this Court at the time of admission of the writ petition. 3.

Since these are two different proceedings, the pendency of the writ petition shall not be construed as a stay to the proceedings before the Appellate Authority. The Appellate Authority shall make every endeavor to dispose of the appeal by 30th December, 2018.

In view of the above, the civil application is allowed and disposed of.
