The learned counsel for the Applicant submits that at present he is not pressing prayer clause (b) of the Civil Application. Statement is accepted.

The learned counsel for the Applicant submits that the Respondent No.1A Bahiru Nilkanth Babar is residing at the same address as mentioned in cause title of the Civil Application, however, avoiding to accept the service. Hence, the Applicant may be permitted to serve the 1/3

Respondent no.1A by private service.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, following order is passed:

a.

The Applicant is permitted to serve the Respondent No.1A Bahiru Nilkanth Babar by private notice by hand delivery and file an Affidavit of service to that effect within 8 weeks.

b.

Civil application stands disposed off accordingly.
