By consent of the parties, following order is passed: a) Impugned order dated 3 August 2023 passed by the District Judge-2, Solapur in Miscellaneous Civil Appeal No.15 of 2023 is quashed and set aside;

b) Miscellaneous Civil Appeal No.15 of 2023 is restored to the file of the Appellate Court;

c) The Appellate Court shall decide the Appeal afresh based on material on record and considering provisions of Chapter IX, and in particular Section 143 of the Maharashtra Land Revenue Code, 1966;

The writ petition stands disposed of in above terms. No costs.
