With the assistance of learned AGP, we have perused the petition. Considering the averments made in petition, we deem it appropriate to dispose of this petition by directing the Respondent No. 1-Board to consider the representation made by the Petitioner seeking recovery of wages due and payable to Mathadi Workers of Toli No.43 and in case the Respondent No.1 is satisied that wages are to be recovered from board, to take necessary steps for recovering the wages from the concerned and also resort to initiating prosecution under Section 44 of the Maharashtra Mathadi, Hamaal and other Patil-SR 1 of

41 Wp-5538-2024.doc manual workers (regulations of employment and welfare) Act, 1971. Ordered accordingly.

The above exercise be carried out by the Respondent No.1, expeditiously.

So far as the prayer clause (b) is concerned, we keep the question open to be decided in an appropriate proceedings. 5.
