The applicant is apprehending arrest in Crime No.414 of 2023 registered with Laxmipuri Police Station, Kolhapur, under Sections 408 and 420 of the Indian Penal Code, 1860.

It is prosecution's case that the applicant was working as Freelancer Reporter in Dainik Pudhari at Kolhapur and he has misappropriated the advertisement fees around Rs.1,62,000/-. 3.

It is contention of learned counsel for the applicant that the applicant has deposited the alleged misappropriated amount of Rs.1,62,000/- before this Court. Learned counsel further submitted that the investigation is completed and charge-sheet has been filed against the SHUBHADA SHANKAR KADAM applicant, hence, custodial interrogation of the applicant is not required SHUBHADA SHANKAR KADAM Date: 2025.02.13 15:57:54 +0530 and requested to allow the application.

Learned APP strongly objected to allow the application and requested to reject the application.

I have heard both learned counsel, perused the FIR and documents produced on record.

The allegations against the applicant are that while working as Freelancer Reporter in Dainik Pudhari at Kolhapur, he has misappropriated the amount of Rs.1,62,000/-. The applicant has deposited the amount of Rs.1,62,000/- before this Court. The investigation is completed and charge-sheet has been filed against the applicant. Considering these facts, applicant's custodial interrogation is not required and I pass following order :

O R D E R

1.

The application is allowed.

2.

The order dated 30th August 2023 passed by this Court (Coram : N. J. Jamadar, J.) is confirmed. 3.

The applicant to co-operate with the Investigating Officer.

The application stands disposed of .
