CORAM

: B. P. COLABAWALLA & SOMASEKHAR SUNDARESAN, JJ.

DATE : MARCH 28, 2024 P.C.

Initially, by order dated 7th February, 2024, we had directed the concerned authority to decide the pending proposals dated 27th September, 2012 and 9th June, 2014 forwarded by the learned Collector, Sangli to the learned Secretary, Revenue Department, Mantralaya, within a period of six weeks from 7th February, 2024.

We had passed these directions because a statement was made that the pending proposals would be decided within a period of six weeks and the decision of the same would be communicated to the Petitioner. With these directions, we had

disposed of the Writ Petition and placed the same on Board for reporting compliance on 21st March, 2024.

On 21st March, 2024, we were informed that the proposals have not yet been decided, and therefore, we had directed the concerned authority to remain present in this Court to explain to us why our order is not complied with. The matter was therefore stood over to today.

Today when the matter is called out, Mr. Patel, the learned Additional AGP has tendered an affidavit in which the authorities have apologized for the delay and have also stated that the proposals dated 27th September, 2012 and 9th June, 2014 have been decided by the concerned authority. Considering the affidavit filed today by Respondent No.1, we find that our order is now complied with. In these circumstances, no further orders are necessary in the above Writ Petition.

We make it clear that if the Petitioner is aggrieved by the decision taken by the concerned authorities on his proposals, he is free to challenge the same in accordance with law.

This order will be digitally signed by the Private Secretary/ Personal Assistant of this Court. All concerned will act order.
