1st December 2024 PC:- 1) Mr. Rote, learned counsel appears for Respondentwife and identified her appearing through video conferencing. 2) By order dated 30th August 2022 passed in Contempt Petition No.212 of 2021 in Interim Application (st) No.95970 of 2022 in Contempt Petition No.158 of 2020 in Family Court Appeal No.68 of 2018, this Court recorded that the wife be permitted to withdraw the Family Court Appeal No.68 of 2018 1/2
22-fca-162-2017.doc and the same stood withdrawn. The Family Court Appeal No.162 of 2017 filed by the husband is pending. The parties have now decided to settle the matter in terms of order dated 30th August 2022. The Settlement Format is taken on record and marked 'X' for identification.
3) In view of the aforesaid, the marriage between the parties dated 9th December 2012 is hereby dissolved in view of the Consent Terms recorded by this Court in order dated 30th August 2022. Admittedly, since the parties have been residing separately for a period of 11 years till date, there is no question of waiving the mandatory six months period as the same has already finished.
4) It is, however, clarified that liberty to the Petitioner to apply for quashing of the F.I.R. filed by his wife against him and/or his relatives is granted. The Respondent-wife undertakes to give her consent and cooperate with the Petition-husband in the proceedings for quashing of the F.I.R.
5) The Petition is disposed of in above terms.
6) The connected matters, i.e., Contempt Petition No.158 of 2020 in Family Court Appeal No.68 of 2018 and Review Petition No.23266 of 2019 in Family Court Appeal No.68 of 2018 are also disposed of.
