None for the Applicants. Heard learned APP for the State and learned Counsel for the Respondent No.2/complainant. 2.

At the outset, learned Counsel for the complainant submits that he has no instructions from the complainant and expressed his inability to assist the Court.

This is an application for pre-arrest bail in connection with CR No. 51 of 2023 registered with Mahabaleshwar Police Station for offence punishable under Section 143, 144, 147, 148, 307, 379, 341, 323, 504 and 506. It is not in dispute that present Applicants who are accused Nos. 4 and 5 in the said FIR, are protected by order of this Court dated 28.08.2023 for about last 2 years. 4.

71-ABA-2391-2023 (CR).doc Police Station (who is present in the Court) submits that investigation is complete and charge-sheet is filed against all accused. He submits that after investigation, the offence under Section 307, 379 and 341 have been dropped and Section 324 is added. He submits that case is already registered as RCC No. 47/2024 in the Court of JMFC, Mahabaleshwar, District Satara.

The allegation against the present Applicants in the FIR is to the extent of snatching gold chain, cash and watch. The order dated 28.08.2023 shows that it was the submissions of the Applicants that in respect of same occurrence, the members of Applicants' party had lodged earlier report/FIR and the present FIR has been lodged as a counter blast.

In the aforesaid facts and circumstances, considering the nature of allegation and further considering the fact that investigation is complete and chargesheet is filed, further consideration that the Applicants were protected by the order of this Court for long time and no grievance about their co-operation with the investigation is made, case for grant of pre-arrest bail is made out. 7.

Anticipatory bail application is allowed in terms of order dated 28.08.2023. The Applicants are directed to attend the dates in the Trial Court unless exempted.
