The present Writ Petition takes exception to order dated 9th March 2021 passed by Respondent No.1/Joint Registrar, Kolhapur Division in Revision Application No.5 of 2020, by which learned Joint Registrar remanded matter back to Assistant Registrar to conduct enquiry afresh on the point specified in order. 2.

It appears that dispute as regard to grant of membership in favour of Petitioner is pending since year 2003. The Petitioners are claiming that in pursuance to order dated 17th July 2006 passed by Assistant Registrar, they have made all compliance, however, Gaikwad RD 1/2

14-wp-12835-2022.doc Respondent No.4-Society did not comply their obligation. It is apparent that Joint Registrar in his order dated 9th March 2021 found that order dated 23rd November 2020 passed by District Deputy Registrar does not answer to all issues, which are required to be considered by him. Eventually, remanded matter back for fresh consideration. Although, learned Advocate appearing for respective parties canvassed submissions on merits of matter before this court, it would be necessary in the interest of justice that all such contentions are considered and findings are recorded by the Competent Authority i.e., Respondent No.3.

In that view of the matter, Writ Petition stands dismissed with directions to Respondent No.3 to consider and decide proceeding afresh in tune with directions given by Joint Registrar in his order dated 9th March 2021 within a period of three months from today. 4.

The parties may put their written notes of argument alongwith relevant documents on the date of appearance before Assistant Registrar, which is fixed as 1st December 2025. by RAJU DATTATRAYA GAIKWAD Date:
