This Application is moved by the applicant for withdrawal of the amount deposited by the appellant/insurance company in Motor Accident Claims Tribunal, Kolhapur.

The learned counsel for the applicant has submitted that the applicant is a driver and his right leg is fractured, therefore, his earning capacity has suffered fully. He has not withdrawn any money till today. 3.

The learned counsel for the respondent/insurance company is present.

Considering this submission, the applicant is allowed to withdraw 1 / 2

30.CAF3421_2015.doc Rs.1,58,000/- by giving an undertaking to the satisfaction of the Tribunal. The remaining amount is to be deposited in a fixed deposit in any nationalized bank.
