Learned counsel for petitioner submits that the present proceedings which arose out of rejection of the stay application filed in the Revision Application would no longer survive for consideration as the Revision Application itself was dismissed for default. He submits that Application for restoration of the Revision Application is filed and in event the application for stay made once again is dismissed, the same would give fresh cause of action. He seeks liberty to challenge the order if adverse to the petitioner. 2.

In light of the above, petition is permitted to be withdrawn as infructuous with liberty as prayed. In view of disposal of petition, Interim/Civil Applications, if any, do not survive for consideration and stand disposed of.
