The learned counsel appearing for the applicant states that a copy of this application has been served upon the advocate for the respondent No.2 who was present when the order dated 10th October 2017 was passed. In view of the averments made in paragraphs6, 7 and 8 of the application, a case for restoration of letters patent appeal is made out which was dismissed for nonprosecution. Accordingly civil application is allowed in terms of prayer clauses (b) and (c). Appeal shall be added to the appropriate weekly board.
