By this application, the applicant is seeking transfer of Marriage Petition No. 159 of 2020 pending before the learned Joint Civil Judge Senior Division Ratnagiri to learned Family Court at Solapur.

It is contention of learned counsel for applicant that the Applicant stays at Solapur. The distance between Ratnagiri to Solapur is around 360 kms. The applicant is finding difficulty to attend Court dates at Ratnagiri. Learned counsel further submitted that the respondent is attending the court dates in DV proceedings at Solapur filed by the applicant. Hence, requested to allow the application by SAJAKALI LIYAKAT JAMADAR Date:

Though respondent served, none present for the respondent. Hence, I am deciding this application on merit. The respondent is attending Court dates at Solapur in the proceedings filed by the applicant. The applicant is finding difficulty to attend the Court dates at Ratnagiri, which is far from Solapur around 360 km. It is settled principal of law that convenience of wife has to be considered over the husband. Considering these facts, I pass following order.

ORDER

(i) Application is allowed;

(ii) Marriage Petition No. 159 of 2020 pending before the learned Joint Civil Judge Senior Division Ratnagiri be transferred to Family Court at Solapur.

The application is allowed in the aforesaid terms and is accordingly disposed off.
