The challenge in this application is Non Bailable Warrant (For short 'NBW') issued by the learned Sessions Judge at Pandharpur in Sessions Case No. 62/2024 vide order dated 24/07/2024. 2.

It is contention of learned counsel for applicant that the applicant has been released on bail. He failed to appear before the learned Sessions Judge. Hence, NBW is issued against him. Learned counsel further submitted that applicant undertakes to attend the Court dates regularly. Hence, requested to allow the application. 3.

It is contention of learned APP that the applicant has been Iresh

91-APL-991-2024 (CR).DOC charged under Sections 376, 376(2)(n), 504 and 506 of the Indian Penal Code. He has not attended Court dates regularly. The crime was registered in the year 2024. The NBW order is rightly passed by the learned Sessions Judge. Hence, requested to reject the application. 4.

I have heard both learned counsels. The applicant has been released on regular bail. The NBW is issued for not attending Court dates regularly. The applicant undertakes to attend Court dates regularly.

In view of above, I pass following order:

O R D E R

I.

The application is allowed.

II.

The NBW issued by the learned Sessions Judge at Pandharpur in Sessions Case No. 62/2024 vide order dated 24/07/2024 is cancelled subject to cost of Rs. 2000/- payable to the first informant. III.

The applicant shall attend the Court dates regularly. 6.
