The learned Addl.G.P. for the Respondent submits that as per earlier order dated 7.3.2018 passed by this court they received instruction from his client Additional Divisional Commissioner that they will decide Appeal No.67 of 2008 filed by the Petitioner within 3 months from today on his own merits.

The learned counsel for the Petitioner submits that in view of the statement made by the learned A.G.P. petitioner may be permitted to withdraw the present Writ Petition with liberty to file afresh in case of Mohite 1/2

32 wp13898-16 urgency. The learned counsel for the petitioner has given in writing to that effect. Same is taken on record and marked 'X' for identification. 4.

The learned A.G.P. after taking instruction from his client makes a statement that Petitioner to remain present before Additional Divisional Commissioner, Pune on 26.3.2018 for fixing date of hearing. 5.

It is made clear that additional Divisional Commissioner to decide Appeal No.67 of 2008 on its own merits. 6.
