Heard. There is a delay of three days in preferring Second Appeal. Though notice is issued, yet service report is awaited. Though certified copy was obtained in time, due to lack of knowledge about the period for filing Second Appeal, there is delay. The suit is of the year 2006. There is partition decree passed against the present Appellant. In fact considering the length of delay, it can be condoned now also. 2.

Hence the delay is condoned, subject to deposit of cost of Rs.1,000/- be paid to Respondents, after they are appear. The Civil Application No.1740 of 2019 is disposed of.

The Second Appeal Stamp No.23726 of 2018 be listed on 27th July, 2022.
